The vast majority of cases (some 90% in York Region) that start in court never make it to trial – which means that 90% of cases started in York Region settle.
Why, then, do we not try and settle more often at the beginning of a case?
Sometimes settlement can be achieved with discussions with the other side and lawyer. That agreement is codified in a Separation Agreement. We may need the help of professionals to guide us with children’s issues, sometimes we need appraisers to set the price of property, other times we need an accountant to value a business or establish true income from self employed persons.
Sometimes we enlist the help of a mediator or arbitrator for out of court settlements or orders. We can discuss whether your case is a good candidate for any type of out of court settlement options.
